Terms of Service

We strive to be one of the most trusted and high-quality online hydroponics retailers on the market. We ask that website users adhere to the Terms of Services outlined below.

OVERVIEW

Throughout the GrowersHouse website (www.growershouse.co.uk), the terms “we”, “us”, and “our” refer to GrowersHouse. 

We welcome all customers under the premise that they adhere to all Terms of Service and are at least of the age of majority in their legal place of residence. By visiting our website and/or making a purchase, you are (a) agreeing that you will comply with these Terms and (b) confirming that you are eligible to use and/or purchase from the GrowersHouse site. 

Please also consult the Privacy Policy for information concerning the ways we use your information. 


Any changes we make to the site will also be subject to these Terms of Service. We will always publish the most current version of the Terms: this version is in effect as of 14 February 2022. As with the Privacy Policy, we will not generally notify individuals of changes, so we recommend that you check periodically to ensure that you are still happy with your customer experience. 


The terms we use throughout the GrowersHouse site are defined as follows:


1. DEFINITIONS

  1. “Seller” means GrowersHouse at the domain www.growershouse.co.uk
  2.  “Buyer” means the individual person who visits or purchases Goods from the Seller. If a business or company buys Goods from the Seller, the purchaser shall not be deemed a Buyer as defined in these Terms of Service. 
  3. “Consumer” falls under the description provided in the Consumer Rights Act 2015.
  4. “Goods” refer to the article(s) that the Buyer purchases from the Seller.
  5. “List Price” describes the prices of the Goods. The List Price is subject to change at the decision of the Seller.
  6. “Terms of Service” (sometimes known as the “Terms and Conditions” or “Terms”) refer to the conditions outlined on this page and/or otherwise specified by the Seller. 


2. USER TERMS

  1. By visiting and/or purchasing from GrowersHouse, Users understand the Terms of Service and Privacy Policy and agree to comply with them at all times. There are to be no variations unless confirmed in writing by the Seller. 
  2. By visiting and/or purchasing from GrowersHouse, Users agree to the cookies used unless otherwise specified and agreed between the Seller and User. More information on these cookies and how to disable them can be found in our Privacy Policy
  3. You may not use our products for illegal or unauthorised purposes or in the violation of any laws in your jurisdiction.
  4. You (the Buyer) must be of legal majority age in your jurisdiction.
  5. It is the Buyer’s responsibility to make sure that all Goods are legal to ship to their country of destination. 
  6. The Seller is not responsible for any charges, rejections, returns, delays, or destruction of Goods by Customs authorities in the country of destination. 
  7. These Terms of Service do not affect the statutory rights of the Buyer. 
  8. In no case shall GrowersHouse or any directors, employees, affiliates, interns, suppliers, officers, agents, contractors, service providers, or licensors be liable for any direct, indirect, incidental, punitive, financial, or consequential injury, loss, claim, or damage of any kind arising from your use of the service, purchases, or use of any content, information, or products sourced from GrowersHouse. 
  9. You agree to indemnify, defend, and hold harmless GrowersHouse and any parent(s), subsidiaries, affiliates, partners, employees, officers, contractors, licensors, agents, service providers, interns, suppliers, and related party(ies) harmless from any claim or demand arising from your breach of these Terms of Services or your violation of any law or the rights of a third party. 
  10. These Terms of Service and any separate agreements where we provide Services shall be governed by and interpreted in accordance with the laws of the United Kingdom. 

3. PROHIBITED USES

  1. In addition to all Terms and Services, you are prohibited from using the site or its content:
  1. For any unlawful purpose;
  2. To solicit others to perform or participate in any unlawful acts;
  3. To violate any international, federal, provincial or state laws, regulations, laws, or policies;
  4. To violate or infringe upon our intellectual property rights or those of others;
  5. To harass, abuse, harm, or intimidate against us or others;
  6. To discriminate against us or others based on, but not limited to: gender, sexual orientation, race, ethnicity, religion, age, nationality, or disability;
  7. To upload or transmit viruses of malicious content;
  8. To interfere with or compromise the security features of the Service or of other sites;
  9. To spam, phish, deceive, or attempt to solicit information or monies through unauthorised and/or fraudulent means;
  10. To collect or track the personal information of others.

4. SELLER TERMS

  1. The Seller may refuse to sell Goods to the Buyer for any reason. These include but are not limited to instances where:
  1. The Goods are out of stock or no longer available;
  2. The Buyer has not provided an adequate method of payment;
  3. The Seller has reason to believe that the Buyer is paying for Goods using inappropriate means (i.e. suspected fraud);
  4. Errors in the pricing or description of the advertised Goods.
  1. The Seller is entitled to refuse sale and/or take further necessary action if they believe that the method of payment supplied by the Buyer is fraudulent or does not belong to the Buyer. This action is intended to confirm whether the Buyer has the right to purchase Goods using this method of payment. The Seller reserves the right to withhold Goods until they are confident that the method of payment is acceptable. This may require the Buyer to provide adequate proof of identification, such as confirming relevant security questions and/or producing relevant and accurate photo identification. 
  2. The Seller is entitled to refuse sale and/or take further necessary action if they believe that the method of payment supplied by the Buyer is fraudulent or does not belong to the Buyer. This action is intended to confirm whether the Buyer has the right to purchase Goods using this method of payment. The Seller reserves the right to withhold Goods until they are confident that the method of payment is acceptable. This may require the Buyer to provide adequate proof of identification, such as confirming relevant security questions and/or producing relevant and accurate photo identification. 
  3. The Seller reserves the right to limit the quantities of items requested by the Buyer. 
  4. If the Seller refuses sale to the Buyer, they shall refund all monies collected, including any delivery costs. However, the Seller is not liable for any losses or costs incurred by the Buyer as a result of refusing to sell the Goods. 

5. PRICE AND PAYMENT

  1. The Buyer must provide relevant and current personal information on purchase, including but not limited to their name, address, phone number, and email address. The Seller is not responsible for any delivery issues that arise from the Buyer’s failure to provide this information and/or keep it up to date. 
  2. The Buyer must provide a relevant and current method of payment on purchase. The payment method must belong to the Buyer. The Seller is not responsible for any issues that arise as a result of inadequate, inaccurate, incomplete, or outdated information from the Buyer. 
  3. The Buyer must make full payment using an appropriate method before dispatch of the Goods.
  4. Where the Buyer uses an international bank account to pay for Goods, the Buyer is responsible for any charges imposed by the bank. 
  5. The price of the Goods is that advertised and/or agreed at the time of purchase. The price includes VAT and does not include any delivery charges or customs duties. 
  6. The Seller reserves the right to amend prices at any time. Should the price of Goods change between a Buyer’s order and dispatch, the Seller will contact the Buyer and inform them of such changes. The Buyer then has the choice to proceed with the transaction or refuse it. The Seller is not responsible for any losses or costs incurred from this. 
  7. The Seller reserves the right to discontinue Goods at any time. Should this occur after agreement of purchase between a Buyer and Seller, the Seller will contact the Buyer to inform them and refund (a) the cost of the Goods and (b) the delivery charge paid by the Buyer. 
  8. Should the price of Goods change after dispatch to a Buyer, the Buyer is NOT responsible for payment of any increase NOR are they liable for any remuneration should the price decrease.
  9. Special offers, sales, and promotions are subject to availability and only apply during the period(s) as advertised.

6. DELIVERY

  1. Delivery of Goods will only occur after a purchase has been agreed between the Buyer and Seller and the Buyer has paid in full using an appropriate method of payment. 
  2. Delivery of Goods will only occur after a legitimate delivery address has been provided and the Seller confirms that it is possible to deliver Goods to this destination. 
  3. All Goods will be delivered within 28 days of purchase wherever possible. 
  4. The Buyer is responsible for taking delivery of the Goods. If they miss a delivery, they are responsible for taking the appropriate action chosen by the courier to retrieve the Goods. In most cases, the courier will make one or two further delivery attempts and/or attempt to contact the Buyer. After this, the Goods will be returned to the Seller. If the Buyer wishes to receive the Goods at this point they will be required to pay a further delivery charge before re-delivery. The Buyer may also choose to cancel the order and receive a refund at the cost of the Goods (excluding delivery charges). 
  5. Title and risk (i.e. ownership and responsibility) will pass to the Buyer upon delivery of the Goods. The Seller is not responsible for any losses, theft, damage, or charges incurred after delivery. This may include: failure of the Buyer to retrieve Goods; loss or theft of the Goods after delivery; or failure to present necessary identification if requested by the courier. GrowersHouse advises that the Buyer receive the delivery in person wherever possible. 
  6. Large and/or multiple items may arrive by pallet. The Seller will make reasonable efforts to inform the Buyer of this before delivery. 
  7. The Seller shall endeavour to deliver Goods on their arranged or estimated date wherever possible. However, they are not responsible for any costs or losses incurred by the Buyer or any third party as a result of late/failed delivery. 
  8. In the event that the Seller fails to (or will fail to) deliver the Goods in the 28 days specified in clause 5.III, the Seller will inform the Buyer. The Buyer will then have the choice to (a) cancel the order and receive a full refund or (b) agree a later delivery date with the Seller.
  9. In the rare instance that the cost of delivery is different from that arranged on purchase, the Seller will contact the Buyer and inform them of this. The Buyer will be responsible for any additional delivery charges. Please bear this in mind, especially if your Goods are being delivered outside of mainland UK. 
  10. If Goods arrive visibly damaged or part of the order is missing, the receiver of the Goods must sign for the delivery with the additional note: “received damaged”. If the Receiver (the person who accepts and signs for the Goods on delivery) fails to note that the Goods have been “received damaged”, the Seller will not be liable for any losses or costs relating to the unsatisfactory arrival of the Goods. 

7. OUR PRODUCTS

  1. We make every effort to ensure that we provide clear information and specifications about our products. We cannot guarantee that the colours displayed on your computer monitor or viewing device will be accurate.
  2. Occasionally we may publish information that contains inaccuracies, typographical errors, omissions. Information may also become outdated. We are not obliged to correct, update, or clarify these inaccuracies except as required by law. However, we reserve the right to correct any errors and update information as necessary. 
  3. Any ambiguities in the interpretation of any information or Terms of Service shall not be construed against the drafting party. 

8. THIRD PARTIES

  1. At times we may provide links to third party websites, products, services, or information. We do our best to use sources that are accurate and informative; however any links or mentions are in no way an endorsement of the third parties or the information provided. We are not responsible for any of the websites, products, services, or information or any losses, costs, damages, or misinformation incurred as a result. Please carefully review the third parties before engaging in any transactions or following advice. Complaints, questions, and claims related to any third party(ies) should be directed to the third party(ies) in question.
